This agreement applies to the website, products and services offered under the brand WAAPI, operated by WAAPI (“we”, “us”, “our”). By accessing or using our services you agree to this agreement. If you do not agree, please discontinue use of the services.

1. The service

WAAPI provides business messaging, automation and related software services on a subscription and/or usage basis. Features, quotas and pricing are described on this website or in your order and may evolve over time.

2. Account & eligibility

You must be at least 18 years old and legally able to contract. You are responsible for the accuracy of the information you register with, for safeguarding your login credentials, and for all activity under your account.

3. Acceptable use

You agree to use the services only for lawful business communication, in line with our Acceptable Use Policy and the policies of any third-party channel you connect (for example the WhatsApp Business terms published by Meta). Spam, unsolicited bulk messaging and unlawful content are strictly prohibited and may lead to immediate suspension.

4. Fees & payment

Charges, billing cycles and accepted payment methods are described in our Payment Policy. All fees are exclusive of applicable taxes (including GST in India) unless stated otherwise. All payments are final as set out in our Refund & Cancellation Policy.

5. Third-party services

The services interoperate with third-party platforms (messaging channels, payment gateways, cloud providers). We are not responsible for those platforms’ availability, pricing or policy decisions, including any restriction they impose on your accounts or numbers.

6. Intellectual property

All software, design and content of the platform remain our property or that of our licensors. You retain full ownership of the data and content you upload; you grant us a limited licence to process it solely to provide the services.

7. Suspension & termination

We may suspend or terminate access for breach of these terms, non-payment, legal requirement, or risk to the platform or other customers. You may stop using the services at any time; termination does not entitle you to a refund of amounts already paid.

8. Warranties & liability

The services are provided “as is” and “as available”. To the maximum extent permitted by law, our aggregate liability for any claim is limited to the fees you paid for the service in the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental or consequential damages, or for loss of profits, data or goodwill.

9. Changes

We may update these terms from time to time. Material changes will be announced on this website or by email; continued use after the effective date constitutes acceptance.

Governing law & jurisdiction

This document is governed by the laws of India. For operators in India this includes the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 (DPDP Act) and the Consumer Protection Act, 2019. Where we serve customers in other jurisdictions, we honour applicable local requirements including the EU/UK General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA) to the extent they apply. Courts at our registered place of business have exclusive jurisdiction, subject to any non-waivable consumer rights in your country of residence.
